Terms of Use

The service

GapProbe is operated by Titas Ghosh. It helps you find local businesses, analyze public signals on their websites, and prioritize which ones may need a service you sell. It is a beta: features, limits and availability may change, and there may be bugs.

Your account

You must be at least 18 and give a valid email address. Keep your password safe; you are responsible for activity on your account. One person per account.

Fair use and beta limits

Each account has daily limits on searches and website analyses, and GapProbe has an overall daily capacity. Do not try to get around these limits, for example with multiple accounts or automation.

Acceptable use

• Use GapProbe only for legitimate business prospecting and research.
• Contact businesses personally and lawfully. Follow the rules that apply to you, such as CAN-SPAM, GDPR, PECR or telemarketing laws, including honouring opt-outs.
• Do not use GapProbe to send bulk unsolicited messages, harass anyone, or misrepresent who you are.
• Do not scrape, reverse engineer, overload or attack GapProbe, or use it to access websites in ways their owners do not allow.
• Do not resell GapProbe data or use it to build a competing database.

Results are signals, not facts

Scores and detections are based only on what GapProbe could see on a business's public pages at the time of analysis. A signal that was not found does not mean a business lacks that technology. Always check before you pitch, and never tell a business it "doesn't have" something based only on GapProbe.

Third-party data

Business listings come from Foursquare and are subject to its terms. Business websites belong to their owners. GapProbe does not guarantee that any listing or website information is accurate or current.

Your content

Notes and feedback you write remain yours. You let us store and process them to run the service, and use feedback to improve GapProbe.

Price

The beta is currently free. If paid plans are introduced, we will tell you before anything is charged, and paid features will have their own terms.

Ending your use

You can stop using GapProbe and ask us to delete your account at any time. We may suspend or close accounts that break these terms or put the service or others at risk.

No warranty and limited liability

GapProbe is provided "as is" without warranties of any kind. To the extent the law allows, the operator is not liable for indirect or consequential losses, lost profits or lost business arising from your use of GapProbe, and total liability is limited to the amount you paid for the service in the previous 12 months (zero during the free beta).

Changes and contact

We may update these terms and will change the effective date above when we do. Continuing to use GapProbe after a change means you accept it. Questions: hello@gapprobe.com.
